On June 24, 2011, the California Court of Appeals lifted a lower court order halting California’s cap-and-trade program. Ass'n of Irritated Residents v. CARB, Cal. Ct. App., No. A132165, 6/3/11. The lower court had ruled that the California Air Resources Board (“CARB”) had failed to comply fully with the California Environmental Quality Act in developing the proposed cap-and-trade program, which is the centerpiece of California’s comprehensive climate change program required under California Assembly Bill 32 (“AB 32”). In lifting the lower court stay pending a final decision on the appeal of the lower court order, the Court of Appeals granted the state’s request that CARB continue work on the program, which is scheduled to become effective in January 2012.

On June 7, 2011, the Western Climate Initiative released draft recommendations for offset project review and approval and for creation of credits in the WCI regional emissions trading program. Under the proposal, offsets meeting certain criteria can be used for compliance with the WCI GHG reduction requirements. In order to be eligible for use in the cap-and-trade program, the offsets will have to validated under rigorous protocols and be subject to a transparent stakeholder involvement process. Comments on the proposal will be accepted until July 8, 2011.

On June 17, 2011, EPA presented the options it is considering for regulating Greenhouse Gas (“GHG”) emissions through New Source Performance Standards (“NSPS”) to a panel representing small businesses. The presentation outlined proposed NSPS for GHG emissions from Electric Generating Units (“EGUs”) and is part of a process initiated in December 2010, when EPA entered into a settlement agreement with environmental groups to issue NSPS for GHG emissions from new and modified natural gas-, oil-, and coal-fired EGUs and emission guidelines for existing natural gas-, oil-, and coal-fired EGUs. Under the agreement, EPA committed to issue the proposed regulations by July 26, 2011 and final regulations by May 26, 2012. The deadline for the proposed rule has now been extended to September 30, 2012, but the final rule deadline remains May 26, 2012.
